Ross Donaldson is a consultant in the Insurance Group.

He has over 23 years' experience as a litigation lawyer focusing on liability and insurance law. During that time, Ross has acted in claims for accountants, barristers, solicitors, estate agents, property valuers, financial planners, fund managers and derivatives traders. His work has involved claims of negligence, breach of contract, misleading and deceptive conduct and breaches of the Corporations Act and the ASIC Act in relation to professional services, including audits, business, taxation and investment advice.

Ross has acted for directors and officers and their insurers in complex claims, including those involving corporate failures and alleged breaches of directors’ duties. He has acted for municipal authorities, statutory authorities and water boards in claims involving planning, building and regulatory process.

Ross provides advice on policy interpretation, professional indemnity, general liability, product liability and directors' and officers' insurance coverage issues.

He regularly acts for building professionals, including engineers, land surveyors, architects, statutory building surveyors, builders and developers in all jurisdictions including the Victorian Civil and Administrative Tribunal. He has conducted the defence of multi-party claims for defective construction works, including defective pavement design, defective design and construction of footings and foundations and the failure of façade works.

Ross also practices in the area of general and product liability, acting for property owners, shopping centre operators, hoteliers, small and medium businesses, recreational and adventure camp operators in property damage claims. He has acted for municipal authorities and statutory and water authorities in negligence claims.

Ross also provides advice on misconduct and disciplinary claims, acting for professionals including barristers, accountants and medical professionals in professional misconduct investigations, inquiries and prosecutions.

Ross was admitted to practice in Victoria in 1985.

He has presented seminars to insurers and law associations on insurance topics, including directors' and officers' insurance, liability of financial planners, legal liability in respect of fire claims, class actions and the liability of educational institutions.
