Retail leasing

Retail leasing is a growing area in conveyancing law and requires a thorough, specialised knowledge.  Even more so following the amendments to the Retail Leases Act in 2005 that largely overhauled retail leasing. There are a number of unique issues that arise when drafting leases for retail premises including rent reviews, provisions for assignment and subletting, obligations to keep premises open, outgoings, fit-out and permitted alterations to the premises and requirements for retail shopping centres.

Commercial leasing

Similarly, commercial leasing involves its own unique set of considerations and CBP partners are experienced in providing comprehensive advice whilst also bearing in mind the commercial interests of the client.

CBP has acted on drafting leases for industrial and commercial offices and has developed suites of lease agreements to cover each individual situation. We can also assist with drafting licence and car park agreements and contracts that incorporate landlord incentives. Partners are skilled in advising on agreements for lease, agreements relating to surrender, relocation, demolition, recission and termination of leases. If disputes arise during the lease term, our experienced partners can advise on enforcement procedures and negotiate changes to the lease.

In relation to licensed premises CBP can advise on acquisition, leasing and sales of such premises and regulations relating to liquor licensing.

Our client list includes public sector, government and statutory corporations and authorities, developers, public companies, educational institutions, strata owner corporations, architects, real estate agents and contractors.
