Stuart joined Colin Biggers & Paisley's restructuring and insolvency team in 2016 and became partner in 2023. He has broad experience in commercial litigation, dispute resolution and debt recovery.

Stuart's primary practice involves acting for and advising insolvency practitioners on disputes under the Corporations Act, Bankruptcy Act and Personal Property Securities Act. He also advises insolvency practitioners, company directors and corporations of all sizes on corporate restructures, including entry into deeds of company arrangement, safe harbour and other schemes of arrangement.

In addition, he has experience acting for large national banks in the enforcement of securities, recovery of unsecured loans and resolving disputes between corporate borrowers and financiers.

Stuart has extensive experience appearing in all civil jurisdictions in New South Wales. He also has strong advocacy skills and regularly appears in court for the hearing of contested applications without the assistance of counsel.

Stuart's recent experience includes:

  • Acting for Scentre Group in proceedings commenced by the liquidators of the Hastie group of companies. Scentre is one of 17 respondents to the liquidators' claim which seeks recoveries of approximately $100 million against all respondents as well as declarations on the nature of bank guarantees that, if accepted, will have a significant impact on commercial relationships in Australia, particularly in the construction industry. The case is currently part heard, with part of the case listed before the Full Court of the Federal Court in November this year.

  • Acting for a builder, Mono Constructions, in a dispute arising from non-payment of amounts owing for the construction of a property development. Making an application on Mono Constructions' behalf to wind up the property developer and subsequently acting for the liquidator of the property developer in pursuing $15 million in compensation for breaches of directors' duties under several sections of the Corporations Act. This case was settled earlier this year.

  • Advising a large construction company on its options after a major sub-contractor was placed into voluntary administration prior to completing a large project. In this matter, the director of the sub-contractor sought to offer up a deed of company arrangement that would impose significant obligations on our client and that sought to reduce the sub-contractor's liability for defective works.

  • Acting for the administrators and then the liquidators of a corporate group that was both a boutique energy provider and pool installation and maintenance business. Assisting the administrators in dealing with the energy regulator and, ultimately, assisting the liquidators with effecting the sale of the entire business to another corporate entity to achieve a return to creditors.

Stuart holds a Bachelor of Arts and a Masters in Professional and Business Ethics in addition to a law degree. He was admitted as a solicitor in 2010 and is admitted to practice in the Supreme Court of New South Wales, the Federal Court and High Court of Australia.
