One of the most impactful components of this Bill is Schedule 2, titled “Statutory Tort for Serious Invasions of Privacy”.
This statutory tort has the potential to affect many areas of legal practice, including across privacy, media, class actions and corporate governance. The consideration for corporate organisations as to data harvesting, data usage, class actions and consent are also very important.
The tort contains many new concepts that draw on similar overseas privacy laws but also includes a unique exemption for journalists publishing journalistic material which is expressed in the sort of language that raises interesting questions as to its scope.
