Insurers are being joined directly to proceedings, what’s driving the trend, how it works and why it matters for construction risk.
Joinder of insurers allows a third-party claimant to directly join an insurer to proceedings. A growing trend in the insurance construction risk space is the joinder of insurers to proceedings directly as defendants (as opposed to being joined via a cross claim). We will discuss this trend generally, including reasons behind it, the various avenues being pursued to achieve joinder and the impact on insurers.
