Amelia Sakaris, solicitor in the Digital Governance, Cyber and Privacy team, explores how artificial intelligence is reshaping privacy - featuring insights on ChatGPT and emerging challenges in data protection.

Key insights:

  • AI tools like ChatGPT collect a surprising amount of personal information - from names and IP addresses to device types and usage times. Even if data is “de-identified,” it may still be used to train its models unless you opt out. 
     
  • The Office of the Australian Information Commissioner has made it clear: privacy obligations apply to any personal information input into, or data generated from, AI systems. If you're using generative AI in your business, you must comply with the Australian Privacy Principles - keep in mind that you may be uploading personal information even if you’re not using someone’s name directly. 

What is best practice? 
 
Avoid entering personal information into publicly available AI tools. And remember, you can manage your data via the ChatGPT privacy portal.
